		<description>I don&#039;t know if you&#039;d want to write on this --- and it might be a waste of time regardless --- but this Hanley piece connects for me with recent decisions by the Supreme Court on the detainees at Gitmo and contemporary sensibilities......any you are a lawyer who could some wight of authority to a discussion of these matters.

Specifically:

Given what the Supreme Court is saying now and current (media) sensibilities.....what do you think they would have to say about North Korean infiltrators and/or South Korean communist rebels taking being caught on the field of battle or carrying arms in a hot area?

What was the legal status of such people - and the legal status of summary courts and the executions they ordered - back then --- and what are the current legal status of them --- how much has the actual rules on the law books changed since 1950?  --- and how much do current sensibilities run counter to/or along with the actual rules in the law books?

People use the word &quot;kangaroo&quot; court, but it seems to me, today, the not just leftists, but a fair percentage of the average people, would consider -- say -- summary courts set up by the allies at (and near) the end of WWII that executed SS and other Germany military and gov members for crimes against locals and Jews -- to be &quot;kangaroo&quot; courts ---- (which of course begs the question of just what kind of court those leaders of criminal mass slaughter should have faced at that time....)....</description>

		<description>Nice rebuttal to Hanley&#039;s latest hit piece.  He wrote a similar article on this topic just two months ago and provided nothing new in this one either.  

He talks about all these secret documents and Freedom of Information request he had to file to find out that some of the KMAG advisers witnessed the executions.  He could have gone to the video store and rented The Korean War in Color that has video of an execution where you can clearly see the KMAG advisers documenting the execution and taking pictures.  

What really bothers me is that he is accusing people of being war criminals and has no convincing evidence to prove it.  What makes it worse is that he goes after people that are now dead and have no way of defending themselves.</description>
